Criminal Simulation

The charge of "criminal simulation" in New Jersey is very closely related to 2C:21-1, forgery. The law states:

N.J.S.A. 2C:21-2. Criminal Simulation. A person commits a crime of the fourth degree if, with purpose to defraud anyone or with knowledge that he is facilitating a fraud to be perpetrated by anyone, he makes, alters or utters any object so that it appears to have value because of antiquity, rarity, source, or authorship which it does not possess.

Kevin C. Orr, Esq., represented a defendant charged with criminal simulation in State v. El Moghrabi, 316 N.J. Super. 139 (App. Div. 1998), where the Appellate Division held that the charge was improperly brought against a defendant, who was also charged with Anti-Piracy Act, 2C:21-21, which prohibits unlawful making or distribution of sound and audiovisual recordings.
